The New York State Workers’ Compensation Board, under the New York State Department of Labor, oversees short-term disability benefits. New York State law requires that every covered employer provides insurance to cover short-term disability benefits for their employees. Under the Workers’ Compensation Board, the New York State Insurance Fund (NYSIF) provides insurance to a vast majority of employers in New York State.
Private insurance companies offer short-term disability to groups and individuals, whereas FMLA is government enforced. Forty-five states do not have any regulations requiring employers to offer an option, or purchase the coverage on behalf of employees. It is a voluntary program requiring proactive action.
Here is where it gets a little sketchy. At the same time I notified my employer that I was living back in NY, I also notified them that I was expecting and would be taking maternity leave. I contacted HR and they provided the necessary paperwork for FMLA and Short Term Disability. I will have 6-8 weeks of Short Term Disability pay after the birth of my child.Use the NYS short-term disability application form DB-450 to file a claim for pregnancy complications before delivery or for maternity leave benefits after childbirth.Complete Use the New York State (NYS) short-term disability insurance application form DB-450 if you were actively employed and you suffered an off-the-job accident or illness. Complete this form if you were working no less than four weeks prior to the start date of your disability to apply for benefit payments.You are eligible to file an NYS short-term disability claim if you suffered an accident or illness on or off the job. You simply complete a different claim form for the type of situation.Complete NYS short-term disability claim form C-3 if you suffered an on-the-job accident or illness.
